1. Agreement to Terms

By accessing or using PaidByAds ("the Platform," "the Service," "the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1.1 Eligibility

• Be at least 18 years old
• Have legal capacity to enter into binding contracts
• Provide accurate identity-verification information
• Comply with all applicable local, state, and federal laws
• Not be located where the Service is prohibited

1.2 Account Requirements

• One account per person (multi-account abuse results in a permanent ban)
• Valid email and phone number for verification
• Government-issued ID for KYC verification (required to withdraw earnings)
• A PayPal account to receive payouts
• A compatible Android device

2. How PaidByAds Works

2.1 The Platform

PaidByAds combines advertising and market research. You participate by completing participation blocks: each block consists of advertising views plus survey or post-ad research questions, with on-device presence verification and periodic gesture challenges confirming genuine, active participation. Research questions are evaluated on participation and response timing, not on whether answers are "right" or "wrong."

2.3 Participation, Verification, and Devices

• Uniform base. The compensation structure for completing participation blocks is the same for all users; PaidByAds does not sell "premium" revenue shares or priority access.
• Bonus pool is performance-based. Eligibility and ranking in the bonus pool reflect verified participation quality. To protect integrity, the scores, subtotals, weights, thresholds, and formulas are not disclosed.
• Multi-device. Registering more than one device is a registration/eligibility feature for participation; it is not a higher revenue share.

3. User Obligations and Conduct

3.1 Presence and Verification

To receive compensation for verified participation, you must:

• Be present during verification windows: your face must be visible to and oriented toward the device camera
• Respond to gesture prompts during participation blocks
• Not attempt to circumvent verification using photos, video, recordings, or AI-generated or simulated input
• Be the verified account holder completing your own participation

3.3 Participation Limits

To prevent abuse and maintain sustainability, the platform applies participation limits and required-participation structures (such as per-day and per-cycle limits and unlock windows) as described in-app. These exist for integrity and sustainability.

4. Payment Terms

• Payout method: PayPal. The name on your payout account must match your verified identity; mismatches may pause a payout for review.
• Minimums and schedule: Minimum payout thresholds and processing timing are disclosed in-app and may change.
• Currency: USD.

4.1 Withheld or Adjusted Payments

We may withhold, delay, or adjust payment if fraud or suspicious activity is detected, an account is under investigation, payout details are invalid or fail identity matching, these Terms are violated, or the law requires it.

5. Identity Verification and AML

To withdraw earnings you must complete email and phone verification and identity verification using a government-issued driver's license or state ID, together with a brief liveness check. We do not match your face against your ID. We maintain anti-money-laundering controls, monitor for suspicious patterns, and keep records as required by law.

6. Privacy and Camera Use

Your privacy is governed by our Privacy Policy. In summary: the app uses the front camera during verified participation to confirm a present, live human (face orientation, facial movement, and mouth movement), processed on your device, with no images or video stored or transmitted for that feature and no gaze tracking or microphone used. Identity verification (KYC) separately transmits your government-issued ID for verification and runs a brief liveness check; your face is not matched against your ID. We do not sell your personal information.

7. Third-Party Search Providers and Informational Content

• PaidByAds may use third-party search providers to identify potentially relevant information.
• Search providers may change over time due to availability, technical requirements, cost, reliability, or platform needs.
• PaidByAds does not control the ranking methodologies used by third-party search providers.
• Results are presented for informational purposes and should not be interpreted as endorsements or recommendations.
• PaidByAds does not endorse products, services, merchants, brands, manufacturers, providers, or search results.
• Users remain solely responsible for evaluating products, services, businesses, and information presented.

8. Intellectual Property

• PaidByAds owns all rights to the app, website, and platform technology, and its name, logo, and branding are proprietary.
• You may not copy, modify, or create derivative works of the platform.
• You grant us the right to use aggregated, anonymized data to operate and improve the platform.

9. Disclaimer of Warranties

PaidByAds is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free service, specific earnings or income, availability of advertisements, compatibility with all devices, or protection against all fraud or abuse.

10. Limitation of Liability

To the maximum extent permitted by law, PaidByAds is not liable for indirect, incidental, or consequential damages; our total liability shall not exceed the amount you earned in the prior 90 days; we are not responsible for third-party services (PayPal, ad networks, search providers, etc.); and you use the platform at your own risk.

11. Indemnification

You agree to indemnify and hold harmless PaidByAds from claims arising from your violation of these Terms or applicable law, your fraudulent or abusive conduct, or your infringement of third-party rights.

12. Account Termination

12.1 By You

You may request account deletion in app settings or by contacting support@paidbyads.com. Eligible outstanding earnings are paid out consistent with these Terms.

12.2 By PaidByAds

We may suspend or terminate accounts for violation of these Terms, suspected fraud or abuse, extended inactivity, legal requirements, or to protect the platform or other users.

12.3 Effects

• Access is revoked.
• Eligible verified earnings are paid (minus any fees owed).
• Fraudulent earnings are forfeited.
• You may not create new accounts after a for-cause termination.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, contact support@paidbyads.com to attempt good-faith informal resolution for 60 days.

13.2 Binding Arbitration

• Disputes not resolved informally shall be resolved by binding arbitration under American Arbitration Association (AAA) rules.
• You waive the right to a jury trial and to participate in class actions.

13.3 Exceptions

Small-claims matters, injunctive relief for intellectual-property violations, and emergency provisional remedies are excepted.

14. Governing Law and Operator

The PaidByAds platform is operated by Quancom Holdings LLC, a Wyoming limited liability company. These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, and arbitration shall be conducted in Cheyenne, Wyoming.

15. Changes to Terms

We may modify these Terms. Material changes will be noticed in-app and/or by email; continued use after changes take effect constitutes acceptance. If you disagree, you may terminate your account.

17. Severability and Entire Agreement

If any provision is found invalid, it will be modified to reflect the parties' intent and the remainder stays in effect. These Terms, with the Privacy Policy, constitute the entire agreement between you and PaidByAds.
